1. Nature of Transactions
Henry David Real Estate markets and sells assignments of purchase contracts ("Contract Interests"). The company holds equitable interest in real property through fully executed purchase agreements with sellers ("Sellers") and offers to assign those contractual rights to qualified buyers ("Assignees") for an assignment fee. Henry David Real Estate does not represent that it holds title to properties advertised unless otherwise expressly stated.
2. Licensed Brokerage
Henry David Real Estate operates under California Real Estate Broker License #01711990, issued by the California Department of Real Estate. All transactions are conducted in compliance with California Business and Professions Code §§ 10000 et seq. and applicable DRE regulations.
3. No Guarantee of Returns
All ARV (After Repair Value) estimates, projected returns, repair cost estimates, and profit projections are estimates based on available market data and are not guaranteed. Past performance does not predict future results. Buyers are solely responsible for independently verifying all property information.
4. Buyer Due Diligence
Prior to closing any assignment, Buyers are solely responsible for conducting independent due diligence including but not limited to: (a) independent property inspection by a licensed inspector; (b) independent title search; (c) independent ARV analysis by a licensed appraiser; (d) review of all applicable zoning, liens, encumbrances, and permits; and (e) consultation with qualified legal and financial advisors.
5. Assignment Fees
Assignment fees are due and payable as specified in the Assignment Agreement. Earnest deposits are non-refundable once an assignment agreement is fully executed except as may be required by law or as expressly stated in the Assignment Agreement.

7. Proof of Funds
All Buyers must provide verifiable proof of funds or a pre-approval letter prior to receiving full property addresses, interior access, or executing any assignment agreement.
8. Limitation of Liability
To the maximum extent permitted by California law, Henry David Real Estate, its owners, agents, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from use of this website or any real estate transaction.
9. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in Contra Costa County, California.
